TWITTER CONTEST

Terms and Conditions


NO PURCHASE NECESSARY. Contest is open to legal residents of the United States and the District of Columbia, 18 years of age or older. Employees of the Sponsors, One World Technologies, Inc., d/b/a Techtronic Industries Power Equipment ("TTIPE") and their immediate families are not eligible to enter. Contest period starts at 5:00 p.m. EDT, Friday, November 13th, 2015, and ends at midnight EDT on Thursday, December 10th, 2015 ("Entry Period").

To be eligible for the Contest, entries must be submitted during the Entry Period by going to www.twitter.com and logging-in to entrant's Twitter account. If entrant does not have a Twitter account, an account can be created by following the instructions on Twitter's website. If creating an account, note that all users must agree to comply with the Twitter Terms of Service. Once logged-in to the entrant's Twitter account take the following steps: (i) become a follower of @RYOBIOutdoor by searching for a clicking on the @RYOBIOutdoor icon and then clocking the "follow" button; (ii) once entrant becomes a follower of @RYOBIOutdoor, entrant must submit a poetic tweet of one-hundred forty (140) characters or less meeting the tweet's content requirements to be a valid entry. The tweet's content requirements are as follows: (i) the poem must be about the entrant's favorite RYOBI Outdoor product; (ii) the poem must rhyme; and (ii) the poem must be original, unpublished, and must not have won any award. Entrants may submit one (1) entry per day during the Entry Period; multiple entries in a single day will not be accepted.
All entries must be received during the Entry Period to be eligible to win the Contest. Upon submission, entries shall become the property of TTIPE. Sponsors reserve the right to use your entry and any comments or images submitted in future marketing campaigns. If any poem contains material that is violent, obscene, illegal, inappropriate, or racially or morally offensive as determined by Sponsor's sole discretion, such poem may be rejected and ineligible for consideration.

A total of one (1) winner will be selected at the expiration of the Entry Period and no later than Friday, December 11th, 2015. From the eligible entries, the judges will select the poem based upon the following criteria, all weighted equally: (i) originality; (ii) content; (iii) clarity; and (iv) creativity. Decisions of the judges are final and binding. The winner will be announced on Twitter in a tweet from @RYOBIOutdoor and notified via a direct Twitter message. One (1) winner will be awarded five-hundred ($500) dollars worth of eligible RYOBI products (approximate retail value is $500.00); such eligible RYOBI products are determined solely by Sponsor and a list of such eligible products will be sent to the winner upon selection.

The winner will be required to provide full name and street address, sign an affidavit of eligibility, a release and a Publicity Release, where permitted. Winner is not entitled to exchange, transfer the prize or obtain a cash substitute. Prize includes shipping and handling. All applicable taxes, including all federal, state, local and other taxes are the sole responsibility of the winner(s). If any winner cannot be contacted within three (3) days of first notification attempt, by twitter, phone or email, if any winner rejects his/her prize, or in the event of noncompliance with these Contest rules and requirements, such prize will be forfeited and an alternate winner may be selected from all remaining eligible entries. Upon prize forfeiture, no compensation will be given. Sponsor is located at 1428 Pearman Dairy Road, Anderson, SC 29625. Sponsor reserves the right to cancel, terminate, modify or suspend the Sweepstakes at anytime in its sole discretion.

By entering this Contest, entrants agree to be bound by Contest rules and by decisions of judges, which are final as to all Contest-related matters. In addition, by participating in this Contest entrants agree to release the Sponsor, its respective parents, subsidiaries, affiliated and successor companies, advertising and promotion agencies and prize suppliers, and the officers, directors, agents, representatives and employees of each (collectively, the "Released Parties") from any and all actions, claims, injury, loss or damage arising in any manner, directly or indirectly, from participation in this Contest and/or acceptance or use of the prize. Entrants also authorize the Released Parties to use their tweet(s), name, voice, likeness, biographical data and city and state of residence in programming or promotional material or on a winner’s list (if applicable) without further compensation unless prohibited by law. These official rules and the interpretation of its terms shall be governed and construed in accordance with the laws of the State of New York without regard to its conflict of laws rules. The parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of New York in the State of New York. The parties agree not to raise the defense of forum non conveniens.

Sponsor is not responsible for failed, partial or garbled electronic transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. Sponsor shall not be liable for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any website. In the event of a dispute over an electronic entry, prize will be awarded to the owner of the Twitter account, not the name provided in the affidavit of eligibility. Anyone found to use multiple twitter accounts will be ineligible for the Contest.
